1. About These Terms

These Terms of Use ("Terms") govern your use of the ML4Schools platform and website ("Platform"), operated by Ninnovate Pty Ltd (ABN 40 693 981 270) ("Ninnovate", "we", "us"). By using the Platform you agree to these Terms — except that for students, your school agrees to these Terms on your behalf (see section 2.4), and we simply ask you to follow them.

These Terms are not a purchase contract — students and teachers pay nothing; schools pay under their own agreement.

2. Who Can Use the Platform

2.1 Student and teacher access is provisioned through a school that holds an active subscription (or via a free/demo account we make available).

2.2 Students use the Platform under their school's authority and their school's own acceptable-use and digital-safety policies.

2.3 You are responsible for keeping your login credentials secure and for activity under your account. Tell your school (or us) promptly if you suspect unauthorised access.

2.4 No age restrictions apply beyond school authorisation. We do not require students to be a particular age, and we do not ask students to enter into a contract with us — your school authorises your access and agrees to these Terms on your behalf. We ask you to follow the rules in section 4 when you use the Platform.

2.5 Accounts can be set up with minimal information. We do not require you to supply complete or additional personal details to use the Platform. Schools may provision accounts using class identifiers or school-chosen display names where their systems support it — we only need what is required to operate your access, as described in the Privacy Policy.

3. Your Licence to Use the Platform

3.1 We grant you a limited, non-exclusive, non-transferable right to access and use the Platform for educational purposes for as long as you are authorised.

3.2 Free content within the Platform remains available outside of a paid subscription. Premium curriculum and features require an active school subscription.

3.3 You must not resell, sublicense, or provide commercial access to the Platform to anyone else.

4. Acceptable Use

You agree not to:

Reporting a problem. If you see content or behaviour on the Platform that breaches this section (or anything that seems harmful or unsafe), report it to your teacher or to support@ninnovate.com.au. We review reports promptly, remove offending content from view while we investigate, and keep the school informed.

Suspension and termination. We may suspend access that breaches this section. Where a student breaches it, we will ordinarily work through the school rather than act directly. Except where we must act immediately to protect the security or safety of the Platform or its users, we will give notice — through your school — before terminating an account, so there is an opportunity to respond. When an account is closed, the information associated with it is handled as described in the Privacy Policy (and, for school-managed data, the school's Data Processing Agreement).

5. Intellectual Property

5.1 The Platform and its content (software, curriculum, ML lab templates, and materials) are owned by Ninnovate and protected by law. Your licence does not transfer ownership.

5.2 Your work stays yours. Work you create through the Platform — ML lab projects, Data Playground submissions, assessment responses — belongs to you (or to your school on your behalf, under its policies). We do not claim ownership of it. We take no licence over your work except the limited technical licence needed to operate the Platform: hosting your work and displaying it back to you, your teachers, and your school. We do not copy, alter, distribute, or display your work to other users, third parties, or anyone else, and we do not use it for marketing or to train AI models.

5.3 If you send us feedback or suggestions, we may use them to improve the Platform without obligation to you.

6. AI Features

The Platform teaches machine learning and includes hands-on ML tools. Some ML activities run entirely in your browser — the data you experiment with is processed on your device and is not sent to our servers for that purpose. Where any AI feature does process information server-side, we describe it in our Privacy Policy and AI Use Statement. Outputs generated by students using these tools belong to the student; your school applies its own rules on using AI-generated content in assessments.

7. Availability and "As Is" Use

7.1 We work to keep the Platform available and reliable (schools have specific availability commitments in the Service Level Agreement), but for individual users the Platform is provided "as is" and we don't guarantee it will be uninterrupted or error-free.

7.2 Nothing in these Terms excludes rights or guarantees you have under the Australian Consumer Law or other laws that cannot be excluded. To the extent we can limit liability by law, we do.

8. Privacy

We handle personal information in line with our Privacy Policy. For students and teachers, your school directs what information we hold on its behalf. We do not sell personal information, show advertising on the Platform, or use student information for marketing or profiling.

9. Changes and Contact

9.1 We may update these Terms from time to time; the current version is always on our website, and material changes affecting schools are notified under the School Services Agreement.

9.2 These Terms are governed by the laws of New South Wales, Australia.
